Privacy Policy

Last updated: April 2, 2026

This Privacy Policy explains how BerryWell, LLC ("BerryWell," "HeyOtto!," "Otto," "we," "us," or "our") collects, uses, stores, and shares personal data in connection with the public website at www.heyotto.app and related marketing pages (collectively, the "Site").

1. Introduction

HeyOtto! is an AI-powered experience designed to give parents the ability to tailor their child's experience and monitor activity, with a focus on a safe, educational environment for kids. By browsing or using the Site, you agree to this Privacy Policy. If you use the HeyOtto! application or sign in at our chat product, additional terms and notices may apply, including our Terms of Service and in-product policies.

For GDPR purposes, BerryWell LLC is the data controller for personal data we process through the Site. We are a Georgia LLC registered in the United States.

2. Scope: this website vs. the HeyOtto! app

This policy describes our practices on the marketing and informational website (heyotto.app). It does not replace the privacy disclosures that apply when you create an account, manage child profiles, or chat in the HeyOtto! application. Those activities are covered by our full Service privacy disclosures presented in the app and at chat.heyotto.app/privacy.

3. Information we collect on the Site

3.1 Information you provide

  • Contact and inquiries: If you use a contact form, email us, or request information, we collect what you submit (for example, name, email address, and the content of your message).
  • Business relationships: If you work with us in a professional capacity, we may collect business contact details you provide.

3.2 Information collected automatically

  • Usage and device data: Such as pages viewed, approximate location derived from IP address, browser type, device type, referring URLs, and dates and times of visits.
  • Cookies and similar tech: See Cookies and tracking technologies.

We do not require you to create an account to read public pages on the Site.

4. How we use your information

  • To operate, maintain, and improve the Site
  • To respond to your questions and support requests
  • To understand aggregated traffic and engagement (for example, which pages are most helpful)
  • To protect the security and integrity of our services
  • To comply with law and enforce our terms

We do not use information collected only through this public Site to run the HeyOtto! chat product; app-related processing is described in our application privacy disclosures.

5. How we share your information

We do not sell your personal information. We may share information with:

  • Service providers who host the Site, provide analytics, deliver email on our behalf, or help us operate our business, subject to appropriate contractual protections.
  • Legal and safety: When required by law, or to protect rights, safety, and security.
  • Business transfers: In connection with a merger, acquisition, or sale of assets, we may transfer information with notice as required by law.

For questions about subprocessors for the Site, contact privacy@berrywell.ai.

6. Children’s privacy (COPPA)

The Site is intended for a general audience and is not directed at children under 13 as a primary audience. We do not knowingly collect personal information from children under 13 through the Site without appropriate consent.

HeyOtto! takes children's privacy seriously and complies with the Children's Online Privacy Protection Act (COPPA) and similar laws in the app experience, where parents create accounts and manage child profiles. If you are a parent and use HeyOtto!, parental controls, consent flows, and children's data practices are described in our COPPA-focused materials and app policies.

For our full COPPA policy as it applies to the Service, see chat.heyotto.app/coppa.

7. Cookies and tracking technologies

We and our partners may use cookies, pixels, local storage, and similar technologies for essential operation of the Site, to remember preferences where applicable, and to measure traffic and campaign performance. Our Site may use tools such as Google Tag Manager and Vercel Analytics as described in their respective policies.

You can control cookies through your browser settings. Blocking certain cookies may affect how the Site functions.

8. Third-party links

The Site may link to third-party sites (including app stores, social networks, or our chat product). Those sites have their own privacy practices; we are not responsible for their content or policies.

9. Your rights and choices

Depending on where you live, you may have rights to access, correct, delete, or port your personal information, or to opt out of certain processing. California residents may have additional rights under the CCPA/CPRA (for example, rights to know, delete, and correct, and to limit use of sensitive personal information). European residents have rights under the GDPR, including to object, restrict processing, and lodge a complaint with a supervisory authority.

To exercise rights related to information collected through the Site, email privacy@berrywell.ai. We will respond within the timeframes required by applicable law.

California residents may request information about our disclosure of personal information to third parties for direct marketing purposes under California Civil Code section 1798.83 by contacting us at the email above.

10. International data transfers

We are based in the United States. If you access the Site from outside the United States, your information may be processed in the U.S. or other countries where we or our providers operate. Where required, we use appropriate safeguards (such as Standard Contractual Clauses) for international transfers.

Our data protection officer for the EEA and UK can be reached at dpo@berrywell.ai.

11. Data retention

We retain personal information for as long as needed to fulfill the purposes described in this policy, unless a longer period is required or permitted by law. Website logs and analytics may be retained for a limited period for security and measurement.

12. Security

We use administrative, technical, and organizational measures designed to protect personal information. No method of transmission or storage is completely secure; you use the Site at your own risk.
